I also agree that smoking whilst driving (in itself) should be banned as part of the 'road-safety issue' (RSI)but it is only likely to be legislated against, when children are present, as part of an amendment to the Children and Families Bill (CFB)
This is for the following reasons as far as I can tell :
At present mobile phone use is presumably allowed for another occupant of the vehicle or whilst the car is stationary (parked), whereas in the case of smoking it would still be desirous for this to be illegal in both cases.
But then what if it is an 'electronic' cigarette? perhaps stick those under the conditions of the mobile phone RSI ??
